New Accounts require 25% down with order, balance due prior to shipping.
Credit will be extended only to those with prior credit approval, net 30 days.
Overdue accounts will be charged a rate of 2% per month, 24% per annum.
Spring orders will be confirmed after fall digging season and completion of inventory.
Claims for errors, shortages, rejections, or any other concern must be made in writing within seven days of receiving stock.
No cancellations will be accepted after stock has been dug or assembled. Cancellations must be received by us a reasonable time prior to digging date.
Guarantee states that nursery stock is true to name and is government inspected. All nursery stock is sold “as is”. We hereby disclaim and exclude all warranties expressed or implied, in fact or by law, including without limitation any warranties of merchantability or fitness for intended use or particular use.
Choice of Law, Forum. The buyer and seller hereto agree that this contract is made in Ohio and shall be governed under Ohio law. Further, any action pertaining to a sale made under this contract shall be venued in Lake County, Ohio.
We offer summer digging. Additional charges may apply for special treatment, and when baskets are requested for items on which we feel it is not normally required.
Quantities of less than 5 may be subject to additional charges.
